Waste Removal Croydon Terms and Service Conditions
These Terms and Service Conditions set out the basis on which Waste Removal Croydon provides waste removal and related services to residential and commercial customers. By booking or using our waste collection services, you agree to be bound by these terms. Please read them carefully before placing a booking.
1. Definitions
In these Terms and Service Conditions, the following expressions have the meanings set out below.
Customer means any individual, business, or organisation that requests or receives waste removal or associated services from Waste Removal Croydon.
Services means the collection, loading, transportation, and disposal or recycling of waste and any related services agreed between Waste Removal Croydon and the Customer.
Waste means any items, materials, rubbish, junk, or refuse the Customer asks us to remove, subject to applicable waste regulations and any exclusions specified in these terms.
Booking means a confirmed arrangement between Waste Removal Croydon and the Customer for the provision of Services at a specified date, time, and location.
2. Scope of Services
Waste Removal Croydon provides waste collection and removal services for households and businesses within our service area. Our Services may include general waste clearance, bulky item collection, office and domestic rubbish removal, and non-hazardous waste disposal.
The exact scope of Services for each Booking will be as agreed at the time of the Customer's request, based on the description of waste, location, access arrangements, and any additional requirements communicated to us.
We reserve the right to refuse to collect certain types of waste, including but not limited to hazardous, dangerous, explosive, corrosive, medical, biological, or other materials prohibited under applicable waste regulations.
3. Booking Process
Bookings for waste removal services may be made by telephone, email, or other communication methods we may make available from time to time.
The Customer must provide accurate and complete information when making a Booking, including the collection address, access details, a description of the waste to be removed, an estimate of volume or weight where possible, and any special circumstances that may affect the provision of the Services.
Any quotation or estimate given before a physical inspection of the waste is based on the Customer's description and is not binding. The final price may be adjusted on arrival if the waste is materially different in type, volume, or accessibility from that described during the Booking process.
A Booking is only confirmed when we have accepted it and provided the Customer with a confirmation, which may be verbal or written. We reserve the right to decline any Booking at our discretion.
4. Service Access and Customer Responsibilities
The Customer is responsible for ensuring that we have safe, unobstructed access to the collection point at the agreed time. This includes arranging access permissions, parking where required, and ensuring that any gates, doors, or communal areas are accessible.
The Customer must ensure that the waste to be collected is clearly separated and identifiable, and that any items not intended for removal are kept apart from the waste.
Where waste is to be removed from inside a property or building, the Customer must ensure that the area is reasonably clear and that the route for removal is safe for our personnel and equipment.
If access is restricted, unsafe, or significantly different from what was described at the time of Booking, we may either cancel the Booking or apply additional charges to cover extra time, labour, or equipment required.
5. Pricing and Quotations
Our prices are typically based on the type of waste, estimated volume or weight, labour required, and any additional services requested. We may provide an estimated price prior to collection based on the information supplied by the Customer.
Where a site visit or visual assessment is carried out before work commences, we will confirm the final price with the Customer before starting the Service. If the Customer does not agree to the revised price, we will not proceed and no charge will be made, except where a call-out fee has been agreed in advance.
Waste Removal Croydon reserves the right to adjust its pricing structure from time to time. Updated prices will apply to future Bookings only and will not affect confirmed Bookings already accepted by us.
6. Payments and Invoicing
Payment terms will be confirmed at the time of Booking. Unless otherwise agreed, payment is due immediately on completion of the Services.
We may accept payment by cash, debit card, credit card, bank transfer, or other methods we notify to the Customer. For business Customers, account arrangements and invoice payment terms may be available by prior agreement.
Where invoicing is agreed, the Customer must pay all invoices in full by the due date specified on the invoice. If payment is not received by the due date, we reserve the right to charge interest on overdue sums, recover reasonable costs of debt collection, and suspend further Services until payment is made.
Ownership of any waste does not revert to the Customer once removed by Waste Removal Croydon, even if payment is outstanding, and we retain the right to recover amounts owed by lawful means.
7. Cancellations and Amendments
The Customer may cancel or amend a Booking by giving us reasonable notice before the agreed collection time. The required notice period will be confirmed at the time of Booking but is typically at least 24 hours prior to the scheduled collection.
If the Customer cancels with less than the required notice, we reserve the right to charge a cancellation fee, which may reflect any costs incurred, including travel time or reserved resources.
Where we arrive at the collection address at the agreed time and are unable to carry out the Services due to the Customer's act or omission, including failure to provide access or the waste not being available, we may treat this as a late cancellation and apply the relevant fee.
Waste Removal Croydon may cancel or reschedule a Booking where necessary due to circumstances beyond our control, including but not limited to severe weather, traffic disruption, vehicle breakdowns, staff illness, or safety concerns. In such cases we will notify the Customer as soon as reasonably practicable and offer an alternative date. We will not be liable for any loss arising from such cancellation or delay, subject to clause 11.
8. Waste Regulations and Compliance
Waste Removal Croydon operates in accordance with applicable UK waste management laws and regulations. We aim to dispose of or recycle waste in a lawful and environmentally responsible manner.
The Customer confirms that they have the right to authorise the removal of the waste and that it does not contain prohibited materials, including but not limited to asbestos, chemicals, solvents, oils, flammable liquids, explosives, clinical or medical waste, pressurised cylinders, or any items specifically identified by us as non-collectable.
If, during collection, we discover or reasonably suspect that the waste includes prohibited or hazardous materials, we may refuse to remove some or all of the waste and may make an additional charge for any extra handling, safety measures, or disposal requirements.
The Customer agrees not to conceal hazardous or prohibited waste within general waste. Any breach of this obligation may result in additional charges, refusal of service, or notification to the relevant authorities where required by law.
9. Customer Property and Site Condition
We will take reasonable care when carrying out the Services at the Customer's premises. However, the Customer is responsible for protecting floors, walls, driveways, and other surfaces that may be susceptible to damage from movement of heavy items or vehicles, where such risk is reasonably foreseeable.
The Customer should notify us of any fragile surfaces, restricted load-bearing areas, or other particular risks on site before work commences. We may refuse to proceed if we consider that the risk of damage or injury is unacceptable.
Our vehicles may be heavy and require sufficient space and suitable ground conditions. If the Customer directs us to drive or park on a particular area, the Customer accepts responsibility for any damage that may reasonably result to driveways, pathways, or underground services, except where caused by our negligence.
10. Customer Cooperation and Behaviour
The Customer, and anyone acting on their behalf, must treat our staff with respect and must not engage in abusive, threatening, or unsafe behaviour. We reserve the right to withdraw our staff and cancel the Services if we reasonably consider that their safety or wellbeing is at risk.
If we are unable to complete the Services due to such behaviour, we may treat the Booking as cancelled by the Customer and charge the applicable cancellation fee.
11. Liability and Limitations
Nothing in these Terms and Service Conditions excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under UK law.
Subject to the above, our total liability to the Customer arising out of or in connection with the Services, whether in contract, tort, or otherwise, shall be limited to the total price paid or payable for the specific Booking giving rise to the claim.
We will not be liable for any indirect, consequential, or economic loss, including loss of profit, loss of income, loss of business, or loss of opportunity, arising from the provision or non-provision of the Services, insofar as such exclusion is permitted by law.
We are not responsible for items mistakenly included in the waste that the Customer did not intend to dispose of. It is the Customer's responsibility to check and confirm which items are to be removed before we commence work. While we will use reasonable efforts to assist in locating any such items reported promptly, we do not guarantee recovery once waste has been removed.
12. Insurance
Waste Removal Croydon maintains appropriate insurance cover for its operations, including public liability insurance, in line with industry practice. Details of our insurance cover are available to Customers on reasonable request.
13. Data Protection and Privacy
We may collect and process personal information about Customers in order to manage Bookings, provide Services, issue invoices, and handle enquiries or complaints.
We will handle such personal information in accordance with applicable UK data protection laws and use it only for legitimate business purposes, such as administering our Services and complying with legal obligations.
We may keep records of Bookings, communications, and transactions for a reasonable period for accounting, legal, and operational reasons.
14. Complaints and Dispute Resolution
If the Customer is dissatisfied with any aspect of our Services, they should contact us as soon as possible, providing a clear description of the issue, the date of Service, and any relevant evidence.
We will investigate complaints in a fair and timely manner and seek to resolve them by explanation, corrective action, or other appropriate remedy where a fault is identified on our part.
Where a dispute cannot be resolved informally, the parties may consider using mediation or another alternative dispute resolution method before pursuing court proceedings, although this is not a formal requirement.
15. Changes to These Terms
Waste Removal Croydon may update or amend these Terms and Service Conditions from time to time. Any revised terms will be published or otherwise communicated and will apply to future Bookings made after the date of the change.
Changes will not affect Bookings already accepted unless required by law or regulation, in which case we will inform the Customer of any material impact on their existing Booking.
16. Severability
If any provision of these Terms and Service Conditions is found by a court or competent authority to be invalid, unlawful, or unenforceable, that provision shall, to the extent required, be deemed not to form part of these terms. The remaining provisions shall continue in full force and effect.
17. No Waiver
Failure or delay by Waste Removal Croydon in exercising any right or remedy under these Terms and Service Conditions shall not constitute a waiver of that right or remedy, nor shall it prevent or restrict any further exercise of that or any other right or remedy.
18. Governing Law and Jurisdiction
These Terms and Service Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Service Conditions or the provision of our waste removal Services.
By placing a Booking or using our Services, the Customer confirms that they have read, understood, and agreed to these Terms and Service Conditions.
